Terms & Conditions

Last Updated: 12 May 2025  ·  Effective Date: 12 May 2025

These terms set out how the studio's workshops, documentation sessions, and membership are offered and what participants can expect when they book a place.

1. About These Terms

These Terms and Conditions govern the relationship between Folioheir (the studio) and individuals who book, purchase, or attend any of the studio's workshops, sessions, or membership offerings. By booking a place or making a payment, you confirm that you have read and accepted these terms.

These terms apply to all offerings listed on this website, including the Personal Folio Workshop, Heritage Documentation Block, and Annual Folio Membership.

2. The Studio

Folioheir is a studio for personal folio building and heritage documentation workshops. We operate from:

  • Block A, Suite 5-1, Jalan Tun Mustapha, 88000 Kota Kinabalu, Sabah, Malaysia
  • Phone: +60 88-244 6371
  • Email: [email protected]

We are a studio offering educational and reflective workshops. We are not a financial advisory firm, a legal service provider, a counselling service, or a healthcare provider. Nothing in any session or material constitutes professional advice of any kind.

3. Our Offerings

3.1 Personal Folio Workshop

A three-hour facilitated workshop in which participants build a personal folio — a single bound document. Sessions are conducted at the studio unless otherwise stated. Group size is capped at eight participants. Each booking is for one participant. The workshop is educational in nature. It does not include legal, financial, or personal advice. Printed materials (a template and a starter folio cover) are included and given to the participant at the session.

3.2 Heritage Documentation Block

A block of three one-to-one sessions in which participants are supported through documenting a piece of family heritage. Sessions are scheduled individually in agreement with the studio. The block is reflective and archival; it is not counselling or personal therapy. Included materials (a printed booklet of the completed document and a follow-up note one month after the final session) are provided to the participant and remain theirs.

3.3 Annual Folio Membership

A twelve-month membership providing sustained facilitation support for one participant who has previously completed a Personal Folio Workshop with Folioheir. The membership includes four quarterly thirty-minute calls with a facilitator, quarterly writing prompts, and an annual printed addition to the folio. The membership is reflective and educational and does not include professional advice. One membership covers one participant only; it is not transferable.

4. Booking and Payment

Bookings are accepted via the contact form on this website, by phone, or by email. A booking is confirmed only once the studio has sent a written confirmation and full payment has been received.

  • Personal Folio Workshop: RM 510 per participant
  • Heritage Documentation Block: RM 1,260 per participant
  • Annual Folio Membership: RM 2,580 per participant per year

Payment is due in full at the time of booking unless a different arrangement is agreed in writing by the studio. Prices are quoted in Malaysian Ringgit (RM) and are inclusive of any applicable taxes. The studio reserves the right to adjust pricing for future bookings with reasonable notice.

5. Cancellation and Changes

5.1 Cancellation by participant

  • Cancellations made more than 14 calendar days before the scheduled session: full payment held as studio credit, applicable to a future booking within 12 months.
  • Cancellations made between 7 and 14 calendar days before the scheduled session: 50% of the session fee held as studio credit.
  • Cancellations made fewer than 7 calendar days before the scheduled session: the session fee is forfeited.

For the Heritage Documentation Block and Annual Folio Membership, cancellation terms apply to the full block or membership value. To cancel, contact the studio in writing at [email protected].

5.2 Rescheduling by participant

Requests to reschedule a session are considered at the studio's discretion and subject to availability. Rescheduling requests made fewer than 48 hours before a scheduled session may not be accommodated.

5.3 Changes or cancellation by the studio

In the event that the studio is unable to proceed with a confirmed session due to circumstances outside its reasonable control (including facilitator illness, venue unavailability, or force majeure), the studio will offer a replacement date or a full credit. Where a replacement cannot be arranged within a reasonable period, a refund of the affected session will be issued.

6. Participation

The studio's workshops and sessions are designed for adults aged 18 and above. Participants are expected to attend in good faith and to engage with the facilitated material at their own discretion. Participation in any session is voluntary; facilitators provide structure and prompts, not direction over the content a participant chooses to document.

The studio reserves the right to remove from a session any participant who acts in a way that is disruptive, harmful, or disrespectful to facilitators or other participants. In such cases, no refund will be issued.

7. Participant Materials

All documents, folios, booklets, and notes produced by participants during sessions belong to the participant. The studio does not retain, copy, photograph, or store any participant-produced content. Printed materials included in each offering (templates, covers, booklets) are given to the participant at the time of the relevant session and become theirs to keep.

8. Intellectual Property

The studio's templates, prompts, guides, and facilitation materials are the intellectual property of Folioheir. Participants are welcome to use these materials for their own personal folio or heritage documentation work. These materials may not be reproduced, distributed, resold, or used to run workshops or sessions by third parties without prior written permission from the studio.

Content created by participants using the studio's templates — including personal notes, family histories, and photographs — belongs to the participant.

9. Scope of Services

The studio provides educational facilitation and structured reflective workshops. Nothing offered by the studio constitutes:

  • Legal advice or legal services of any kind
  • Financial advice, investment advice, or financial planning
  • Counselling, psychotherapy, or any form of mental health support
  • Medical advice or healthcare services
  • Estate planning or will preparation
  • Genealogical research services (the studio supports participants in documenting their own knowledge; it does not conduct external research on their behalf)

Participants who require services of the kinds listed above are encouraged to consult the appropriate qualified professionals.

10. Limitation of Liability

The studio takes care in the delivery of its workshops and sessions. However, the studio's liability to any participant is limited to the amount paid by that participant for the relevant session or membership. The studio is not liable for any indirect, consequential, or special loss arising from participation in or reliance on any workshop, session, or material. Nothing in these terms excludes liability for fraud or for death or personal injury caused by the studio's negligence.

11. Privacy

Personal data collected in connection with bookings and enquiries is handled in accordance with our Privacy Policy, which forms part of these terms. By booking a place, participants consent to the processing of their personal data as described in the Privacy Policy.

12. Governing Law

These terms are governed by the laws of Malaysia. Any dispute arising under these terms will be subject to the non-exclusive jurisdiction of the courts of Malaysia.

13. Changes to These Terms

The studio may update these terms from time to time. The current version will always be published on this website. Changes take effect from the date of publication. For bookings already confirmed at the time of a change, the terms in force at the time of confirmation will apply.
